Terms and conditions

These terms apply to every purchase from Lumotag at https://lumotag.co.za. They are written to comply with the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). Nothing in them limits the rights those Acts give you.

We sell NFC tags programmed with a link to a web page that we host for you. Current prices: NFC stickers, 5-pack: R199; NFC card: R249; NFC key fob: R179. Orders of 5 to 9 units of one product receive 10% off, and 10 or more receive 15% off.

All prices are in South African rand and are the full price payable. Lumotag is not registered for VAT, so no VAT is charged. Delivery is charged separately at checkout: Pudo locker to locker: R65; Courier to your door: R109.

Product images are illustrations. Colours and finishes may vary slightly between production batches.

3. Placing an order

You can review and change your cart, delivery details and total before you pay. Your order is accepted, and a contract is formed, when Payfast confirms your payment and we send you an order confirmation by email. If we cannot fulfil an order, we will tell you and refund you in full.

4. Payment and security

Payments are processed by Payfast, a registered South African payment service provider. You enter your card or banking details on Payfast's secure page; we never see or store them. Our website is served only over encrypted HTTPS connections.

5. Programming and delivery

We programme each tag with its unique link, permanently lock it against rewriting and test it on iPhone and Android before dispatch. Orders are dispatched within 5 working days of payment by Pudo locker or courier, and we email you a tracking number. Delivery times after dispatch depend on the courier. Ownership and risk pass to you on delivery or collection.

6. Your tag page and content

• Each tag opens a page hosted by us. You are responsible for the content you give us, and you confirm you have the right to publish it.
• Content may not be unlawful, misleading, defamatory, infringe anyone's rights, collect personal information without a lawful basis, or link to scams or malware. We may refuse such content and switch off a tag that is used this way.
• Content updates are free. Send your changes to hello@lumotag.co.za from the email address used for the order.
• We intend to keep tag links working for as long as the service operates. If we ever stop the service, we will give at least 6 months' notice by email.

7. Cancellation and returns

You may cancel within 7 days of receiving your order, without giving a reason, as provided by section 44 of ECTA. Defective products are covered for 6 months under section 56 of the CPA. Full details are in our returns and refunds policy.

8. Phone compatibility

Tags work with iPhone XS and later and most Android phones with NFC switched on. Older iPhones and some entry-level Android phones cannot read NFC tags. Standard tags do not work when applied directly to metal.

9. Liability

To the extent the CPA allows, we are not liable for indirect or consequential loss, or for loss caused by content you supply, by third-party services your page links to, or by a phone's inability to read NFC. Our total liability for an order is limited to the amount paid for it. This does not exclude liability for gross negligence or any liability that cannot be excluded by law.

10. Privacy

We handle personal information as set out in our privacy notice, in line with the Protection of Personal Information Act 4 of 2013 (POPIA).

11. Complaints and disputes

Please contact us first at hello@lumotag.co.za and we will respond within 5 working days. If we cannot resolve your complaint, you may approach the Consumer Goods and Services Ombud or the National Consumer Commission.

12. General

These terms are governed by the laws of the Republic of South Africa. We may update them from time to time; the version on this page when you placed your order applies to that order.
